The Allahabad High Court has strongly criticized the Uttar Pradesh Police for illegally detaining an individual before arrest, stating it appears the police are operating under their own laws. Justices Atul Sreedharan and Achal Sachdev noted the Assistant Commissioner of Police and investigating officer were unaware of the procedures under the BNSS. The court highlighted a pattern of mandatory legal procedures not being followed, with documents appearing to be mere formalities.

इलाहाबाद हाई कोर्ट ने एक व्यक्ति को गिरफ्तारी से पहले अवैध रूप से हिरासत में रखने के लिए उत्तर प्रदेश पुलिस की कड़ी आलोचना की है, और कहा है कि ऐसा लगता है कि पुलिस अपने ही कानूनों के तहत काम कर रही है। जस्टिस अतुल श्रीधरन और अचल सचदेव ने नोट किया कि सहायक पुलिस आयुक्त और जांच अधिकारी BNSS के तहत प्रक्रियाओं से अनजान थे। अदालत ने इस बात पर प्रकाश डाला कि अनिवार्य कानूनी प्रक्रियाओं का पालन नहीं किया जा रहा है, और दस्तावेज़ महज़ औपचारिकता लगते हैं।
