Retired Judge Can Claim Allowances From Parent High Court, Rules Orissa HC

The Orissa High Court has ruled that a judge transferred to another high court before retirement is eligible to claim post-retirement allowances from their original state. The ruling came while considering a petition by Justice (retired) Chitta Ranjan Dash, who retired from Calcutta High Court after serving the Orissa HC for nearly 13 years. The court cited a Supreme Court clarification recognizing the entitlement of judges transferred between high courts.

ओडिशा हाई कोर्ट ने फैसला सुनाया है कि रिटायरमेंट से पहले दूसरे हाई कोर्ट में ट्रांसफर हुए जज को उनके मूल राज्य से रिटायरमेंट के बाद के भत्ते का दावा करने का हक है। यह फैसला जस्टिस (सेवानिवृत्त) चितरंजन दास की याचिका पर आया, जिन्होंने ओडिशा HC में लगभग 13 साल सेवा देने के बाद कलकत्ता हाई कोर्ट से रिटायरमेंट लिया। कोर्ट ने सुप्रीम कोर्ट के एक स्पष्टीकरण का हवाला दिया, जिसमें हाई कोर्ट के बीच ट्रांसफर हुए जजों के हक को मान्यता दी गई है।
