Kerala HC Directs Centre To Make Data Protection Board Functional In Eight Weeks

The Kerala High Court has ordered the Union government to make the Data Protection Board, established under the Digital Personal Data Protection Act, 2023, operational within eight weeks. This directive came while addressing a public interest litigation concerned with the privacy of passenger data at airports. The court noted that citizens' privacy was indeed being compromised, highlighting concerns about the collection, storage, and transmission of sensitive personal information. Previously, the court had ruled against mandatory Aadhaar details for Digi Yatra, accepting driving licenses as proof of identity.

केरल हाईकोर्ट ने केंद्र सरकार को आदेश दिया है कि वह डिजिटल व्यक्तिगत डेटा संरक्षण अधिनियम, 2023 के तहत स्थापित डेटा संरक्षण बोर्ड को आठ हफ्तों के अंदर चालू करे। यह निर्देश हवाई अड्डों पर यात्रियों के डेटा की गोपनीयता से संबंधित एक जनहित याचिका पर सुनवाई के दौरान आया। अदालत ने कहा कि नागरिकों की गोपनीयता से समझौता हो रहा है, और संवेदनशील व्यक्तिगत जानकारी के संग्रह, भंडारण और प्रसारण को लेकर चिंताएं जताईं। इससे पहले, अदालत ने डिजी यात्रा के लिए अनिवार्य आधार विवरण के खिलाफ फैसला सुनाया था, और पहचान के प्रमाण के तौर पर ड्राइविंग लाइसेंस को स्वीकार किया था।
