SC Mandates Judicial Oversight for Re-arrests

The Supreme Court has established strict judicial oversight to prevent police abuse during re-arrests. A bench ruled that police must obtain specific sanction from a Judicial Magistrate before re-arresting someone whose initial arrest was illegal due to rights violations. This ensures decisions are not arbitrary and requires recorded reasons for the re-arrest attempt. Disciplinary action may also be initiated against officers violating constitutional rights.

सुप्रीम कोर्ट ने पुलिस की मनमानी रोकने के लिए सख्त नियम बनाए हैं। अब अगर किसी की पहली गिरफ्तारी गलत तरीके से हुई है, तो पुलिस उसे दोबारा गिरफ्तार करने से पहले मैजिस्ट्रेट से खास इजाजत लेगी। कोर्ट ने कहा है कि ऐसा करने के कारण भी बताने होंगे। अगर कोई पुलिस वाला किसी के अधिकारों का उल्लंघन करता है, तो उस पर कार्रवाई भी हो सकती है।
