The restaurant was unable to reopen following extensive flooding and an electrical fire in December 2020 and January 2021. Forthwell argued it should recover Lynnet's lost profits, but the court rejected the proposed legal exception under Scots law. The dispute over the landlord's repair obligations remains unresolved, leaving the restaurant's future uncertain.
