Oral Allegations Insufficient For Divorce Without Proof, Rules Karnataka HC

Times of India · india

The Karnataka High Court's Dharwad bench has overturned a Family Court's divorce decree, stating that mere oral allegations of cruelty without concrete proof or corroboration are insufficient to grant a divorce. The court found that the Family Court had wrongly granted divorce to the husband based on the wife's police complaint. It also noted that the husband's unsubstantiated allegations and denial of paternity constituted cruelty towards the wife. The bench emphasized that such reckless statements, especially when denying paternity of a child born during marriage, amount to cruelty.
