Bombay High Court Quashes ED FIR in Goa Illegal Mining Case

The Bombay high court at Goa has quashed a 2013 First Information Report (FIR) filed by the Enforcement Directorate (ED) concerning the Goa illegal mining case. The court ruled that since the Goa police FIR was already quashed due to a decade-long lack of progress, the ECIR also becomes legally invalid. The court emphasized that without a subsisting predicate offence, the ED cannot prosecute for money laundering.

गोवा में बॉम्बे हाई कोर्ट ने गोवा अवैध खनन मामले से जुड़ी प्रवर्तन निदेशालय (ईडी) की 2013 की पहली सूचना रिपोर्ट (एफआईआर) रद्द कर दी है। कोर्ट ने कहा कि चूंकि गोवा पुलिस की एफआईआर एक दशक से प्रगति न होने के कारण पहले ही रद्द हो चुकी थी, इसलिए ईडी की ईसीआईआर भी कानूनी रूप से अमान्य हो जाती है। कोर्ट ने इस बात पर जोर दिया कि बिना किसी मौजूदा अपराध के, ईडी मनी लॉन्ड्रिंग के लिए मुकदमा नहीं चला सकता।
