New Landlord Cannot Evict Tenants Immediately After Property Sale
Aaj Tak · india
When a rented property is sold, new landlords cannot force tenants to vacate immediately. Indian law protects tenants' rights, meaning a sale does not automatically end a tenancy. The Transfer of Property Act, 1882, states that the new owner inherits the previous landlord's rights and obligations. This includes respecting the existing rental agreement's terms and duration. New owners must follow legal procedures, like providing proper notice, if they wish to end the tenancy, especially if the rental agreement has not expired or if the tenant has not violated its terms.
