SC Restores Land Acquired For Housing Society After 38 Years

The Supreme Court has quashed a 1988 land acquisition by the Karnataka government near Bengaluru, restoring about 59 acres to its original owners after 38 years. A bench of Justices J B Pardiwala and K Vinod Chandran stated that land can only be acquired for a public purpose, not for the benefit of private individuals or organisations. The court observed that the acquisition process indicated fraud played on citizens and directed the state government to pay Rs 50,000 to the litigant landowners.

सुप्रीम कोर्ट ने कर्नाटक सरकार द्वारा बेंगलुरु के पास 1988 में किए गए भूमि अधिग्रहण को रद्द कर दिया है, जिससे 38 साल बाद लगभग 59 एकड़ जमीन उसके मूल मालिकों को वापस मिल गई है। जस्टिस जे बी पारदीवाला और के विनोद चंद्रन की पीठ ने कहा कि जमीन केवल सार्वजनिक उद्देश्य के लिए अधिग्रहित की जा सकती है, न कि निजी व्यक्तियों या संगठनों के लाभ के लिए। अदालत ने देखा कि अधिग्रहण प्रक्रिया में नागरिकों के साथ धोखाधड़ी हुई थी और राज्य सरकार को मुकदमेबाजी करने वाले भूस्वामियों को 50,000 रुपये का भुगतान करने का निर्देश दिया।
