Orissa HC Rules SC/ST Status Not Transferable Between States

Times of India · india

The Orissa High Court has ruled that individuals cannot claim Scheduled Caste (SC) or Scheduled Tribe (ST) status in a new state based on their classification in their original state. The court quashed a decision that required prior permission for land sale by a Jharkhand resident, Binoy Krishna Das, whose caste is notified as SC in Jharkhand but not in Odisha. Justice Sashikanta Mishra stated that SC/ST status is state-specific, determined by presidential notifications reflecting local socio-economic conditions.
