Supreme Court Rules Courts Cannot Suggest Custodial Interrogation
Hindustan Times · india
The Supreme Court has ruled that courts cannot suggest to investigating agencies that an accused or suspect should be subjected to custodial interrogation. A bench of justices Ujjal Bhuyan and Atul S Chandurkar emphasized that the decision rests solely with the investigating agency. The court cautioned that sweeping observations on the need for custody could jeopardize an individual's liberty. This ruling came while granting anticipatory bail to a retired principal and his wife accused of manipulating service records to extend tenure and draw over ₹10.75 lakh in salary.
