The Supreme Court has overturned a Karnataka High Court ruling that decreed a partition suit concerning ancestral properties. The apex court held that the plaintiffs failed to prove the sale of disputed lands by their predecessor lacked legal necessity. Justices Augustine George Masih and Sandeep Mehta found the High Court erred by relying on unsubstantiated allegations of gambling and drinking, while ignoring evidence like the plaintiffs' failure to establish property market value and the non-examination of the deceased's wife.
