इलाहाबाद हाई कोर्ट ने 'दुश्मन संपत्ति' की परिभाषा और पहचान की प्रक्रिया को साफ किया है। मुजफ्फरनगर में 90 वर्ग मीटर के प्लॉट पर एक विवाद की सुनवाई करते हुए, अदालत ने कहा कि अधिकारी केवल किसी संपत्ति को 'दुश्मन' या 'शरणार्थी' बताकर निर्माण नहीं रोक सकते, जब तक कि औपचारिक रिकॉर्ड न हो। अदालत ने अधिकारियों को मालिकों के कब्जे में हस्तक्षेप करने से रोक दिया, क्योंकि उन्हें ऐसी कोई आधिकारिक रिकॉर्ड नहीं मिला जिसमें जमीन को ऐसा नामित किया गया हो। यह फैसला दुश्मन संपत्ति अधिनियम, 1968 के तहत संपत्ति मालिकों के खिलाफ कोई भी कार्रवाई करने से पहले उचित दस्तावेज़ीकरण की आवश्यकता पर जोर देता है।
