Supreme Court: 24-Hour Arrest Rule Starts From Detention, Not Formal Arrest
Times of India · top
The Supreme Court has ruled that the constitutional mandate to produce an arrestee before a magistrate within 24 hours begins from the moment of detention for interrogation, not from the time of formal arrest. A bench of Justices Ujjal Bhuyan and Atul S Chandurkar quashed high court verdicts that had allowed a distinction between detention and arrest. This ruling aims to prevent custodial violence by ensuring individuals are not held indefinitely without judicial oversight. The court emphasized that no artificial distinction should be created, as liberty is curtailed upon detention.
