Breakups Not Rape If Sex Was Consensual: Supreme Court

The Supreme Court has ruled that consensual sexual relations between adults in a relationship cannot be termed rape simply because the relationship ended. A bench stated that the legislature never intended to criminalize consensual sexual activities post-breakup. The court distinguished between relationships based on initial deceit and those where regret arises after the relationship ends. While the latter is unfortunate, it does not justify criminalizing consensual acts, thereby protecting the accused's liberty and reputation.

सुप्रीम कोर्ट ने फैसला सुनाया है कि किसी रिश्ते में वयस्कों के बीच सहमति से बने यौन संबंध को सिर्फ इसलिए बलात्कार नहीं कहा जा सकता क्योंकि रिश्ता खत्म हो गया है। एक बेंच ने कहा कि विधायिका का इरादा कभी भी ब्रेकअप के बाद सहमति से होने वाली यौन गतिविधियों को अपराध बनाना नहीं था। अदालत ने शुरुआती धोखे पर आधारित रिश्तों और उन रिश्तों के बीच अंतर किया जहां रिश्ता खत्म होने के बाद पछतावा होता है। जबकि बाद वाला दुर्भाग्यपूर्ण है, यह सहमति से किए गए कार्यों को अपराध ठहराने का औचित्य नहीं देता है, जिससे आरोपी की स्वतंत्रता और प्रतिष्ठा की रक्षा होती है।
