Karnataka HC: Drug Licence Cannot Be Suspended Before Hearing

The Karnataka High Court has ruled that a drug licensing authority cannot suspend a pharmaceutical distributor's licence without first providing an opportunity to respond. The court directed authorities to treat a show-cause notice issued to Wellness Forever Chemists and Lifestyle Store as a preliminary notice. The distributor had challenged the suspension order, arguing it was unlawful as it was issued alongside the notice. The court allowed the distributor to continue business while authorities reconsider the matter, except for two specific injections.

कर्नाटक हाईकोर्ट ने फैसला सुनाया है कि दवा लाइसेंसिंग अथॉरिटी, जवाब देने का मौका दिए बिना किसी फार्मास्युटिकल वितरक का लाइसेंस निलंबित नहीं कर सकती। कोर्ट ने अथॉरिटी को वेलनेस फॉरएवर केमिस्ट्स एंड लाइफस्टाइल स्टोर को जारी कारण बताओ नोटिस को प्रारंभिक नोटिस मानने का निर्देश दिया। वितरक ने निलंबन आदेश को चुनौती दी थी, यह तर्क देते हुए कि नोटिस के साथ ही इसे जारी करना गैरकानूनी था। कोर्ट ने अथॉरिटी को मामले पर पुनर्विचार करते हुए वितरक को दो खास इंजेक्शनों को छोड़कर अपना व्यवसाय जारी रखने की अनुमति दी।
