Bombay HC Sets Aside DNA Test Order

The Bombay High Court has set aside a civil court's order directing a DNA test for a 19-year-old claiming to be the illegitimate son of a deceased hotelier. Justice Sandeep Marne stated that DNA tests are not routine and parties must first prove paternity claims through other evidence. The court emphasized that such tests should only be ordered in exceptional cases where evidence is insufficient to resolve the controversy.

बॉम्बे हाईकोर्ट ने डीएनए टेस्ट का आदेश रद्द किया

बॉम्बे हाई कोर्ट ने एक सिविल कोर्ट के उस आदेश को रद्द कर दिया है जिसमें एक मरे हुए होटल व्यवसायी के 19 साल के नाजायज बेटे के डीएनए टेस्ट का निर्देश दिया गया था। जस्टिस संदीप मार्ने ने कहा कि डीएनए टेस्ट कोई आम बात नहीं है और पार्टियों को पहले दूसरे सबूतों से पितृत्व का दावा साबित करना होगा। कोर्ट ने जोर दिया कि ऐसे टेस्ट केवल असाधारण मामलों में ही होने चाहिए, जब विवाद सुलझाने के लिए सबूत काफी न हों।
