Allahabad HC: Police Cannot Illegally Detain Relatives to Pressure Accused

The Allahabad High Court has ruled that police cannot unlawfully detain innocent relatives of an accused to force their surrender. Such actions violate personal liberty and entitle the victim to compensation. The court awarded Rs 40,000 to Arvind Kumar Yadav, who was illegally detained for four days at George Town police station in Prayagraj. The compensation is to be recovered from the salaries of the responsible police personnel. The court also directed that its displeasure be recorded in the service records of the investigating officer and the SHO.

इलाहाबाद हाई कोर्ट ने फैसला सुनाया है कि पुलिस किसी आरोपी के निर्दोष रिश्तेदारों को जबरन सरेंडर कराने के लिए अवैध रूप से हिरासत में नहीं ले सकती। ऐसे कार्य व्यक्तिगत स्वतंत्रता का उल्लंघन करते हैं और पीड़ित को मुआवजे का हकदार बनाते हैं। कोर्ट ने अरविंद कुमार यादव को 40,000 रुपये का मुआवजा दिया, जिन्हें प्रयागराज के जॉर्ज टाउन पुलिस स्टेशन में चार दिनों तक अवैध रूप से हिरासत में रखा गया था। यह मुआवजा जिम्मेदार पुलिसकर्मियों के वेतन से वसूला जाना है। कोर्ट ने यह भी निर्देश दिया कि जांच अधिकारी और SHO के सेवा रिकॉर्ड में उनकी नाराजगी दर्ज की जाए।
