Prohibitory Orders Losing Effectiveness Due To Unpunished Violations, Court Notes

Times of India · top

A Delhi court has observed that prohibitory orders are losing their impact due to frequent violations with minimal consequences. Additional Sessions Judge Parveen Kumar Singh highlighted that if laws are not enforced, public respect for them diminishes, making restoration difficult. The judge emphasized the need for deterrent punishment to discourage violations, citing recent Delhi protests and the 2020 riots. Seven men convicted of violating Section 144 CrPC were sentenced to six months rigorous imprisonment, underscoring the court's stance against open defiance of lawful orders.
