Allahabad HC Quashes Dowry FIR, Cautions Against Criminalizing Marital Disputes

The Allahabad High Court has expressed concern over the tendency to turn disputes in short-lived marriages into criminal cases. A bench quashed an FIR alleging dowry harassment, physical violence, and attempted murder, stating that criminalizing every troubled marital relationship can undermine the institution of marriage. The court noted that no record of domestic violence complaints or police intervention at the time of alleged incidents was presented. While emphasizing the need to protect women from dowry violence, the court warned against the misuse of criminal laws in marital disputes.

इलाहाबाद हाई कोर्ट ने छोटी अवधि के विवाहों में विवादों को आपराधिक मामलों में बदलने की प्रवृत्ति पर चिंता जताई है। एक बेंच ने दहेज उत्पीड़न, शारीरिक हिंसा और हत्या के प्रयास के आरोप वाली FIR को रद्द कर दिया, और कहा कि हर परेशान वैवाहिक रिश्ते को आपराधिक बनाना विवाह संस्था को कमजोर कर सकता है। अदालत ने नोट किया कि कथित घटनाओं के समय घरेलू हिंसा की शिकायतों या पुलिस हस्तक्षेप का कोई रिकॉर्ड पेश नहीं किया गया था। दहेज हिंसा से महिलाओं की रक्षा करने की आवश्यकता पर जोर देते हुए, अदालत ने वैवाहिक विवादों में आपराधिक कानूनों के दुरुपयोग के खिलाफ चेतावनी दी।
