Court Upholds 1963 Sale Deed After 51-Year Legal Battle Over Land

A Muzaffarnagar court has dismissed a 48-year-old land claim by the Nagar Panchayat Shahpur, bringing relief to the heirs of Ilmchand Arya. The additional district judge upheld a registered sale deed executed in 1963, setting aside a lower court's 2017 judgment. The court found the UP Zamindari Abolition and Land Reforms Act, 1950, inapplicable and noted a previous Allahabad high court ruling in 1955 that applied the principle of 'res judicata'. The civic body's suit, filed in 1975 claiming the land as public property, was dismissed as barred by limitation.

मुजफ्फरनगर की एक अदालत ने नगर पंचायत शाहपुर के 48 साल पुराने ज़मीन के दावे को खारिज कर दिया है, जिससे इल्मचंद आर्य के वारिसों को राहत मिली है। अतिरिक्त जिला न्यायाधीश ने 1963 में निष्पादित एक पंजीकृत बिक्री विलेख को बरकरार रखा और निचली अदालत के 2017 के फैसले को रद्द कर दिया। अदालत ने पाया कि उत्तर प्रदेश ज़मींदारी उन्मूलन और भूमि सुधार अधिनियम, 1950 लागू नहीं होता है और 1955 में इलाहाबाद उच्च न्यायालय के एक पिछले फैसले का उल्लेख किया जिसमें 'रेस जूडिकाटा' के सिद्धांत को लागू किया गया था। 1975 में दायर नागरिक निकाय के मुकदमे में ज़मीन को सार्वजनिक संपत्ति बताते हुए, समय-बाधा के कारण खारिज कर दिया गया था।
