Loan Guarantors Retain Fundamental Rights, Rules Madras High Court

The Madras High Court has ruled that citizens do not forfeit their constitutional rights, including the right to travel, simply by taking out a bank loan or acting as a guarantor. Justice V. Lakshminarayanan emphasized that the right to free travel is a fundamental right under Article 21 of the Constitution. He stated that a bank manager's letter to immigration authorities does not constitute 'law' to restrict this right.

मद्रास हाईकोर्ट ने फैसला सुनाया है कि बैंक लोन लेने या गारंटर बनने मात्र से नागरिकों के संवैधानिक अधिकार खत्म नहीं हो जाते, जिसमें यात्रा का अधिकार भी शामिल है। जस्टिस वी. लक्ष्मीनारायणन ने इस बात पर जोर दिया कि स्वतंत्र रूप से यात्रा करने का अधिकार संविधान के अनुच्छेद 21 के तहत एक मौलिक अधिकार है। उन्होंने कहा कि किसी बैंक मैनेजर का इमिग्रेशन अधिकारियों को लिखा पत्र इस अधिकार को प्रतिबंधित करने के लिए 'कानून' नहीं माना जा सकता।
