The Gujarat High Court has quashed a CBI court's decision to use a woman's police statement as evidence in a separate case. The court ruled that statements recorded by police under Sections 161 and 162 of the Code of Criminal Procedure are not substantive evidence. Such statements can generally only be used to contradict the maker during cross-examination. The High Court further clarified that these statements cannot be used as admissions or confessions against a person who later becomes an accused in separate proceedings.
