A woman claimed exemption under Section 54F after using Rs 8.31 crore from selling shares to buy her husband's Mumbai property for Rs 7.5 crore. The Income Tax Department deemed it tax avoidance, arguing the transaction was a 'colourable device'. However, the Income Tax Appellate Tribunal (ITAT) Mumbai ruled in her favour on July 17, 2026. The tribunal found no evidence that the transaction was not genuine or pre-arranged for tax evasion.

एक महिला ने शेयर बेचकर मिले 8.31 करोड़ रुपये से अपने पति की मुंबई की प्रॉपर्टी 7.5 करोड़ में खरीदी। उसने सेक्शन 54F के तहत टैक्स छूट मांगी। इनकम टैक्स विभाग ने इसे टैक्स बचाने का तरीका माना। लेकिन, इनकम टैक्स अपीलेट ट्रिब्यूनल (ITAT) मुंबई ने 17 जुलाई 2026 को महिला के पक्ष में फैसला सुनाया। ट्रिब्यूनल को टैक्स चोरी का कोई सबूत नहीं मिला।
