The Himachal Pradesh High Court has overturned a conviction in a cheque dishonour case, ruling that the complaint was filed prematurely. Justice Rakesh Kainthla stated that the complaint under Section 138 of the Negotiable Instruments Act was lodged before the statutory period for payment expired. The court presumed the demand notice was served 30 days after issuance, and the complaint was filed within the subsequent 15-day payment window.

हिमाचल प्रदेश हाई कोर्ट ने एक चेक बाउंस मामले में सज़ा को पलट दिया है, यह कहते हुए कि शिकायत समय से पहले दायर की गई थी। जस्टिस राकेश कैंथला ने कहा कि Negotiable Instruments Act की धारा 138 के तहत शिकायत भुगतान की वैधानिक अवधि समाप्त होने से पहले ही दर्ज कर ली गई थी। अदालत ने माना कि मांग सूचना जारी होने के 30 दिन बाद तामील हुई, और शिकायत बाद की 15-दिन की भुगतान अवधि के भीतर दायर की गई थी।
