ITAT Chennai Grants Full Tax Exemption On Leave Encashment To Retired Bank Employee

A retired bank employee who received Rs 12.27 lakh as leave encashment in 2020 and claimed a Rs 3 lakh tax exemption has been granted the full amount as tax-free by the ITAT Chennai. The exemption limit for non-government employees was subsequently increased from Rs 3 lakh to Rs 25 lakh in May 2023. The tribunal ruled that the enhanced limit could benefit employees who retired before the change, even if their tax proceedings were ongoing.

2020 में लीव इनकैशमेंट के तौर पर ₹12.27 लाख पाने वाले एक सेवानिवृत्त बैंक कर्मचारी को ITAT चेन्नई ने पूरी राशि टैक्स-फ्री कर दी है, जबकि उन्होंने ₹3 लाख की टैक्स छूट मांगी थी। मई 2023 में गैर-सरकारी कर्मचारियों के लिए छूट की सीमा ₹3 लाख से बढ़ाकर ₹25 लाख कर दी गई थी। ट्रिब्यूनल ने फैसला सुनाया कि बढ़ी हुई सीमा उन कर्मचारियों को भी लाभ पहुंचा सकती है जो बदलाव से पहले रिटायर हो गए थे, भले ही उनके टैक्स संबंधी मामले चल रहे हों।
