Homebuyers who have taken possession of a delayed property can still claim interest for the period the developer failed to deliver. The Lucknow bench of the Allahabad High Court upheld this, dismissing an appeal by Antriksh Developers. The court ruled that accepting possession does not extinguish a buyer's statutory claim for delay interest. This decision clarifies that buyers are entitled to compensation for the time lost, even after moving into their homes. The Real Estate (Regulation and Development) Act, 2016, supports claims for interest on delayed possession.
