सुप्रीम कोर्ट के जस्टिस उज्ज्वल भुइयां ने कहा कि लाखों नागरिकों को वोट से वंचित करने वाली कोई भी प्रक्रिया मनमानी है और संवैधानिक व्यवस्था को नकारती है। उन्होंने जोर देकर कहा कि भारतीय संविधान नागरिकों के दो वर्ग नहीं बनाता है, एक वोट देने के अधिकार वाला और दूसरा बिना वोट के। किसी मृतक को छोड़कर, बिना नोटिस और सुनवाई के मतदाता का नाम हटाना अस्वीकार्य है। जस्टिस भुइयां ने वोट देने के अधिकार को भारत के स्वतंत्रता संग्राम से जोड़ा और इसे मूल संरचना सिद्धांत का एक केंद्रीय हिस्सा बताया।
