Wife's Unwillingness To Live Together Valid Ground For Divorce: Madras High Court
Times of India · india
The Madras High Court has ruled that a wife's explicit unwillingness to live with her husband constitutes a valid ground for divorce. The court emphasized that forcing a couple to remain together against the wife's stated wishes is unsustainable. This decision overturned a Karaikal family court's May 22, 2020 order that had denied divorce to a hearing and speech-impaired husband. The husband had cited his wife's refusal to live with him, even after his willingness to leave his mother and sister, as grounds for dissolution.
