Orissa High Court Dismisses Plea Against Textbook Paper Tender Eligibility

The Orissa High Court has dismissed a private paper supplier's challenge to the state government's tender for textbook paper procurement. The court observed that tendering authorities have the freedom to set eligibility conditions based on their requirements. A division bench stated that courts should exercise caution when examining administrative decisions on tender conditions, interfering only if arbitrariness or mala fide is proven.

ओडिशा हाईकोर्ट ने पाठ्यपुस्तक पेपर खरीद के लिए राज्य सरकार की निविदा को एक निजी पेपर आपूर्तिकर्ता की चुनौती को खारिज कर दिया है। अदालत ने देखा कि निविदा प्राधिकरणों के पास अपनी आवश्यकताओं के आधार पर पात्रता शर्तें निर्धारित करने की स्वतंत्रता होती है। एक खंडपीठ ने कहा कि अदालतों को निविदा शर्तों पर प्रशासनिक निर्णयों की जांच करते समय सावधानी बरतनी चाहिए, केवल मनमानी या दुर्भावना साबित होने पर ही हस्तक्षेप करना चाहिए।
