Kerala HC Rules Woman Can Exclusively Own Joint Property Bought With Father's Money

The Kerala High Court has ruled that a woman can be the exclusive owner of a property purchased jointly with her husband if the funds originated from her father. The court noted the husband's admission that the title deed was in the petitioner's possession. While denying claims for gold and money, the High Court upheld the Family Court's decision granting the wife exclusive ownership of the residential property. The husband has been directed to vacate the premises within three months.

केरल हाईकोर्ट ने फैसला सुनाया है कि अगर किसी संपत्ति को खरीदने के लिए पैसा महिला के पिता से आया है, तो वह अपने पति के साथ मिलकर खरीदी गई संपत्ति की अकेली मालकिन हो सकती है। कोर्ट ने पति के इस बयान को नोट किया कि टाइटल डीड याचिकाकर्ता के कब्जे में है। सोने और पैसे के दावों को खारिज करते हुए, हाईकोर्ट ने पारिवारिक अदालत के उस फैसले को बरकरार रखा जिसमें पत्नी को आवासीय संपत्ति का एकमात्र स्वामित्व दिया गया था। पति को तीन महीने के भीतर परिसर खाली करने का निर्देश दिया गया है।
