Mani C Kappan Challenges MLA Disqualification Plea

Pala MLA Mani C Kappan has challenged a petition seeking his disqualification as an MLA following his conviction in four cheque cases. Kappan argued that the constitutional mechanism for disqualification involves the Governor and the Election Commission, not the Speaker. He also contended that individual sentences in the four cases were less than two years, thus not attracting disqualification under the Representation of the People Act. The petitioner had sought disqualification based on the aggregated sentence of three-and-a-half years.

मणि सी कप्पन ने विधायक अयोग्यता याचिका को दी चुनौती

पाला के विधायक मणि सी. कप्पन ने अपनी अयोग्यता को चुनौती दी है। उन पर चेक बाउंस के चार मामलों में दोषी पाए जाने के बाद विधायक पद से हटाए जाने की याचिका दायर की गई थी। कप्पन का कहना है कि अयोग्यता का संवैधानिक अधिकार राज्यपाल और चुनाव आयोग के पास है, स्पीकर के पास नहीं। उन्होंने यह भी कहा कि हर मामले में सजा दो साल से कम है, इसलिए जनप्रतिनिधित्व कानून के तहत अयोग्यता लागू नहीं होती।
