BSNL, MTNL Retirees' Tax Exemption Capped at Rs 5 Lakh by CBDT

Business Standard · business

The Central Board of Direct Taxes (CBDT) has clarified that employees who took voluntary retirement under the BSNL and MTNL VRS-2019 scheme cannot claim tax exemption by treating their compensation as retrenchment benefits. The ex-gratia amount paid under the scheme is considered voluntary retirement compensation, with the tax exemption limited to Rs 5 lakh under Section 10(10C) of the Income Tax Act. Payments exceeding this limit are generally taxable as salary income. This clarification settles the tax department's position on such retirement payments.
