Bombay HC: Bar On Anticipatory Bail Under BNSS Not Absolute

Times of India · india

The Nagpur bench of the Bombay High Court has ruled that the statutory bar on anticipatory bail under Section 482(4) of the Bharatiya Nagarik Suraksha Sanhita (BNSS) is not absolute. Courts can examine if allegations prima facie satisfy the ingredients of specified offences before deciding on the maintainability of a pre-arrest bail application. Justice MM Nerlikar stated that if statutory ingredients are prima facie established, the bar operates; otherwise, the application remains maintainable.
