Trust Cannot File Consumer Complaint, Rules Kerala State Commission
Times of India · india
The Kerala State Consumer Disputes Redressal Commission has ruled that a trust is not considered a "person" under the Consumer Protection Act, and therefore cannot file a consumer complaint. The commission reversed a district commission's decision that had allowed a complaint filed by Cochin Thirumala Devaswom Committee. It cited a Supreme Court ruling stating trusts do not fall within the Act's definition of a person. The commission clarified that a precedent remains binding even if referred to a larger bench, until modified.
