Miami Judge Rules Federal Noncitizen Voting Law Unconstitutional

A US District Judge in Miami has ruled that a federal law criminalizing voting by noncitizens is unconstitutional. Judge David Leibowitz dismissed a case against Chelsea Cox, who was charged with illegally voting in the 2020 presidential election. He found that only individual states, not Congress, have the authority to set voter qualifications. While this ruling applies only to Cox's case, about 45 similar cases remain pending nationwide. The Department of Justice has charged at least 60 people with this offense since January 2025.
