CM Vijay's Counsel Questions ECI on Byelection Stance

Tamil Nadu Chief Minister C. Joseph Vijay's senior counsel argued that the Election Commission of India cannot render a pending court case infructuous by deciding not to conduct byelections. The ECI informed the Madras High Court that it would not notify byelections to five vacant Assembly constituencies until election petitions related to them are disposed of. The counsel questioned whether this decision was suo motu or based on a representation. He emphasized that constituents cannot remain unrepresented in the Assembly for an extended period.

तमिलनाडु के मुख्यमंत्री सी. जोसेफ विजय के वरिष्ठ वकील ने दलील दी कि चुनाव आयोग (ECI) किसी लंबित कोर्ट केस को अमान्य करके उपचुनाव न कराने का फैसला नहीं कर सकता। ECI ने मद्रास हाई कोर्ट को बताया कि वह पांच खाली विधानसभा सीटों के लिए उपचुनाव की अधिसूचना तब तक जारी नहीं करेगा जब तक उनसे संबंधित चुनाव याचिकाओं का निपटारा नहीं हो जाता। वकील ने सवाल किया कि क्या यह फैसला स्वतः संज्ञान से लिया गया या किसी अर्जी पर आधारित था। उन्होंने इस बात पर जोर दिया कि मतदाताओं को लंबे समय तक विधानसभा में प्रतिनिधित्व के बिना नहीं रहना चाहिए।
