Delhi HC: Predicate Offence Protection Not For PMLA

The Delhi High Court has ruled that protection granted in a predicate offence does not automatically extend to proceedings under the PMLA. Justice Madhu Jain stated that a petitioner cannot claim pre-arrest protection in PMLA cases solely based on protection received in the predicate offence. दिल्ली हाई कोर्ट ने फैसला सुनाया है कि किसी मुख्य अपराध में मिली सुरक्षा, मनी लॉन्ड्रिंग रोकथाम अधिनियम (PMLA) के तहत चलने वाली कार्यवाही पर अपने आप लागू नहीं होती। जस्टिस मधु जैन ने कहा कि याचिकाकर्ता केवल मुख्य अपराध में मिली सुरक्षा के आधार पर PMLA मामलों में गिरफ्तारी से पहले राहत का दावा नहीं कर सकता। इससे PMLA मामलों की अलग कानूनी स्थिति स्पष्ट हो गई है।
