Calcutta HC Shields Emami Agrotech From FSSAI Coercive Action

The Calcutta High Court has granted Emami Agrotech protection against coercive action following a notice from the Food Safety and Standards Authority of India (FSSAI). The FSSAI had alleged that the brand name 'Emami Healthy & Tasty' used on edible oil products was misleading. Emami Agrotech challenged the notice, asserting that 'Emami Healthy & Tasty' is a registered trademark. Justice Krishna Rao directed that no coercive steps be taken against the company until the next hearing.

कलकत्ता हाई कोर्ट ने Emami Agrotech को फूड सेफ्टी एंड स्टैंडर्ड्स अथॉरिटी ऑफ इंडिया (FSSAI) से मिले नोटिस के बाद किसी भी तरह की जबरन कार्रवाई से सुरक्षा प्रदान की है। FSSAI ने आरोप लगाया था कि खाने के तेल उत्पादों पर इस्तेमाल किया गया ब्रांड नाम 'Emami Healthy & Tasty' भ्रामक है। Emami Agrotech ने नोटिस को चुनौती देते हुए कहा कि 'Emami Healthy & Tasty' एक रजिस्टर्ड ट्रेडमार्क है। जस्टिस कृष्णा राव ने निर्देश दिया कि अगली सुनवाई तक कंपनी के खिलाफ कोई भी जबरन कदम न उठाया जाए।
