Kerala HC: Centre Can Use Patent For Exorbitant

The Kerala High Court has ruled that the Central government can utilize a patent for a medicine to manufacture and sell it to the public, especially underprivileged patients, on a non-commercial basis. Justice Harisankar V. Menon stated the Centre should intervene when patented medicines are priced exorbitantly, by invoking provisions under the Patents Act, 1970. The court emphasized the government's duty to ensure citizens have access to life-saving treatments.

केरल हाई कोर्ट ने फैसला सुनाया है कि केंद्र सरकार किसी दवा के पेटेंट का इस्तेमाल करके उसे आम जनता, खासकर गरीब मरीजों को गैर-व्यावसायिक आधार पर बनाने और बेचने के लिए कर सकती है। जस्टिस हरिशंकर वी. मेनन ने कहा कि जब पेटेंट वाली दवाओं की कीमत बहुत ज्यादा हो, तो केंद्र को पेटेंट एक्ट, 1970 के प्रावधानों का इस्तेमाल करके दखल देना चाहिए। कोर्ट ने इस बात पर जोर दिया कि सरकार का यह कर्तव्य है कि वह नागरिकों को जीवन रक्षक इलाज मुहैया कराए।
