Allahabad HC: DM Must Refer Property Release Pleas To Court If Rejected Under Gangsters Act

The Allahabad high court has ruled that a district magistrate must refer a property release plea to the competent court if rejecting it under the Gangsters Act. The observation came while quashing a Firozabad DM's order that rejected a representation for the release of attached property. The court noted that the DM failed to make the mandatory reference to the court as required by Section 16(1) of the Act. The bench directed the DM to reconsider the petitioner's representation for property release within two months.

इलाहाबाद HC: गैंगस्टर एक्ट के तहत खारिज होने पर DM को संपत्ति रिलीज की अर्जी कोर्ट भेजनी होगी

इलाहाबाद हाई कोर्ट ने फैसला सुनाया है कि गैंगस्टर एक्ट के तहत संपत्ति रिलीज की अर्जी खारिज करने पर जिला मजिस्ट्रेट (DM) को उसे सक्षम अदालत में भेजना होगा। यह टिप्पणी फिरोजाबाद के DM के उस आदेश को रद्द करते हुए आई जिसमें जब्त संपत्ति को छोड़ने की अर्जी खारिज कर दी गई थी। कोर्ट ने कहा कि DM ने एक्ट की धारा 16(1) के तहत जरूरी रेफरेंस कोर्ट को नहीं किया। बेंच ने DM को दो महीने के अंदर याचिकाकर्ता की संपत्ति रिलीज की अर्जी पर फिर से विचार करने का निर्देश दिया।
