The Supreme Court has ruled that a confession made while in police custody cannot, by itself, be the sole basis for a preventive detention order under the National Security Act. A Bench comprising Justices Dipankar Datta and Sheel Nagu found such detention unsustainable if it relies only on a confessional statement without independent supporting material. This decision came in a case involving violence in Sambhal, Uttar Pradesh, where an individual's detention was challenged.
