J&K High Court Restores Suit Dismissed Due To Elderly Plaintiff's Illness

The Jammu and Kashmir and Ladakh High Court has ruled that a civil suit can be restored if the plaintiff missed hearings due to old age or health problems. The court upheld the restoration of an ejectment suit filed by an elderly man, Ali Mohammad Shora, who had missed several hearings. Shora applied to reopen the case within seven days of its dismissal, citing health issues and his lawyer's absence.

जम्मू-कश्मीर और लद्दाख हाई कोर्ट ने फैसला सुनाया है कि अगर वादी बुढ़ापे या स्वास्थ्य समस्याओं के कारण सुनवाई में शामिल नहीं हो पाता है तो दीवानी मुकदमा बहाल किया जा सकता है। अदालत ने एक बुजुर्ग व्यक्ति, अली मोहम्मद शोरा द्वारा दायर बेदखली के मुकदमे की बहाली को बरकरार रखा, जो कई सुनवाई में शामिल नहीं हो पाए थे। शोरा ने स्वास्थ्य समस्याओं और अपने वकील की अनुपस्थिति का हवाला देते हुए, खारिज होने के सात दिनों के भीतर मामले को फिर से खोलने के लिए आवेदन किया था।
