Delhi HC: Muslim Law No Excuse for POCSO

The Delhi High Court has ruled that Muslim Personal Law cannot be used to seek exemption from criminal liability in cases involving sexual relations with a minor wife. Justice Sanjiv Narula stated that allowing such claims would undermine the POCSO Act. The court refused to quash a case against a man accused of sexually exploiting his wife, who was 16 years and three months old at the time of marriage. The court rejected the argument that a marriage valid under Muslim Personal Law negates criminal liability for subsequent sexual relations.

दिल्ली हाई कोर्ट ने फैसला सुनाया है कि नाबालिग पत्नी से यौन संबंध के मामलों में आपराधिक देनदारी से छूट मांगने के लिए मुस्लिम पर्सनल लॉ का इस्तेमाल नहीं किया जा सकता। जस्टिस संजीव नरूला ने कहा कि ऐसे दावों की इजाजत देने से POCSO एक्ट कमजोर होगा। कोर्ट ने एक ऐसे व्यक्ति के खिलाफ मामला खारिज करने से इनकार कर दिया, जिस पर अपनी पत्नी का यौन शोषण करने का आरोप है, जो शादी के समय 16 साल और तीन महीने की थी। कोर्ट ने इस दलील को खारिज कर दिया कि मुस्लिम पर्सनल लॉ के तहत वैध विवाह बाद के यौन संबंधों के लिए आपराधिक देनदारी को नकारता है।
