Allahabad HC Asks Law Commission to Revisit Pocso Act Provisions for Minor Couples

The Allahabad High Court has urged the Law Commission to recommend amendments to the Pocso Act, 2012, concerning minor couples, citing prevailing social realities in India. The court noted that strict application of the Act can sometimes lead to injustice, especially when a relationship results in a child. It suggested exploring alternative punishments like community service to avoid disrupting families formed out of ignorance of the law.

इलाहाबाद हाई कोर्ट ने लॉ कमीशन से Pocso Act, 2012 के उन प्रावधानों में संशोधन की सिफारिश करने को कहा है जो नाबालिग जोड़ों से संबंधित हैं। कोर्ट ने कहा कि भारत की सामाजिक हकीकतों को देखते हुए, इस एक्ट को सख्ती से लागू करने से कभी-कभी अन्याय हो सकता है, खासकर जब रिश्ते से बच्चा पैदा होता है। कोर्ट ने सुझाव दिया कि कानून की अज्ञानता से बने परिवारों को टूटने से बचाने के लिए सामुदायिक सेवा जैसी वैकल्पिक सजाओं पर विचार किया जाए।
