Pune Man Freed as HC Rules Assault Not

The Nagpur High Court has quashed the preventive detention order against a Pune resident, Shrinath alias Tikya Ashok Shelar. A division bench found that the alleged assault, stemming from a verbal altercation and subsequent assault on an intervener, constituted a "law and order" issue rather than a disturbance of "public order." The court noted that ordinary legal provisions were not shown to be inadequate and that the detention order relied on unsigned statements.

नागपुर हाई कोर्ट ने पुणे के रहने वाले श्रीनाथ उर्फ टक्या अशोक शेलार के खिलाफ़ निवारक नज़रबंदी के आदेश को रद्द कर दिया है। एक डिवीज़न बेंच ने पाया कि कथित हमला, जो एक मौखिक बहस और बीच-बचाव करने वाले पर हुए हमले से शुरू हुआ था, 'पब्लिक ऑर्डर' में गड़बड़ी के बजाय 'लॉ एंड ऑर्डर' का मामला था। कोर्ट ने कहा कि आम कानूनी प्रावधानों की अपर्याप्तता नहीं दिखाई गई और नज़रबंदी का आदेश बिना हस्ताक्षर वाले बयानों पर आधारित था।
