Supreme Court: Cops Can't Seek Digital Footprints For Roving Probes
Times of India · top
The Supreme Court has ruled that police cannot compel social media platforms to share an accused person's digital footprints from periods predating the alleged crime. The court stated that provisions of the Information and Technology Act should not be misused for 'roving and fishing inquiries' that breach the right to privacy. Justices Surya Kant and Joymalya Bagchi emphasized the need for proportionality in police investigations, allowing digital footprint requests only when alternative methods prove inadequate. This order, protecting journalist Abhishek Upadhyay, is expected to set a precedent for privacy rights.
