The Allahabad High Court has quashed a cheating case against a doctor running a fertility centre, stating that the failure of a medical procedure like IVF does not inherently constitute cheating under Section 420 of the Indian Penal Code. The court emphasized that proving cheating requires demonstrating deceptive intent from the outset, not merely an unsuccessful medical outcome. It noted that medical science is not exact and doctors cannot guarantee results. Allowing criminal prosecution for every failed procedure would unfairly expose medical professionals to legal action.

इलाहाबाद हाईकोर्ट ने एक फर्टिलिटी सेंटर चलाने वाले डॉक्टर के खिलाफ धोखाधड़ी का मामला रद्द कर दिया है। कोर्ट ने कहा कि आईवीएफ जैसी मेडिकल प्रक्रिया का असफल होना, भारतीय दंड संहिता की धारा 420 के तहत अपने आप में धोखाधड़ी नहीं माना जा सकता। कोर्ट ने जोर दिया कि धोखाधड़ी साबित करने के लिए शुरू से ही धोखे का इरादा दिखाना ज़रूरी है, न कि सिर्फ एक असफल मेडिकल नतीजा। कोर्ट ने यह भी कहा कि मेडिकल साइंस सटीक नहीं है और डॉक्टर नतीजे की गारंटी नहीं दे सकते। हर असफल प्रक्रिया के लिए आपराधिक मुकदमा चलाने की इजाजत देने से मेडिकल पेशेवरों को कानूनी कार्रवाई का सामना करना पड़ेगा।
