Madras HC questions MLA resignations, voter rights

The Madras high court observed that while an elected MLA has an absolute right to resign, the rights of the voter should not be violated. The court noted that elected MLAs resigning and then contesting immediately on another party's symbol presents a problem. A division bench directed the Election Commission of India to explain steps to protect voters' constitutional rights in such peculiar situations.

मद्रास हाई कोर्ट ने कहा कि विधायक के इस्तीफे का अधिकार है, लेकिन वोट देने वाले मतदाताओं के हक़ का हनन नहीं होना चाहिए। कोर्ट ने माना कि विधायक का इस्तीफा देकर तुरंत दूसरी पार्टी के सिंबल पर चुनाव लड़ना गलत है। कोर्ट ने चुनाव आयोग से कहा कि ऐसे हालात में वोटरों के संवैधानिक हक़ की हिफाज़त के लिए उठाए जाने वाले कदमों के बारे में बताएं।
