Supreme Court to Hear Petitions Against Election Commissioner Immunity Act

Times of India · politics

The Supreme Court has consolidated two petitions challenging Section 16 of the Chief Election Commissioner and Other Election Commissioners Act, 2023. This provision grants serving and former election commissioners immunity from civil and criminal proceedings for actions taken while discharging official duties. Petitioners argue this offers broader protection than that given to the President, MPs, and judges, potentially shielding officials from prosecution even for corruption or mala fide actions. They contend that unlike the President, former commissioners might not be prosecutable after leaving office, raising concerns about accountability.
